Tax planning

Tax avoidance vs tax evasion

Stay compliant. Protect your business. Avoid costly penalties.

Tax avoidance is legal planning to reduce tax using available reliefs, incentives and sound structuring. Smart, legitimate, and recommended when done by an accredited practitioner.

Tax evasion is illegal — deliberate concealment or falsification to pay less tax (no returns, false invoices, undeclared income). Carries heavy penalties, interest and possible criminal charges.

Esibayeni Esihle Services supports SMEs and individuals with ethical, professional tax planning that minimises liability while staying firmly within the law.

SARS disputes

SARS says you owe — but you disagree. What now?

Don’t just pay — know your rights.

Under the Tax Administration Act 28 of 2011, you have the right to object to an assessment or certain SARS decisions (S104), appeal a disallowed objection (S107), and request suspension of payment in appropriate circumstances while disputing a tax liability (S164).

Review the assessment. Understand the reasons and check the details. Submit your objection within the prescribed time limit. If you disagree with the outcome, appeal if necessary.

A dispute does not automatically stop SARS collection. Consider suspension of payment where appropriate. Don’t miss the deadline — get professional advice early.
